Disclaimer / Terms & Conditions

The Arizona Assistive Technology Exchange (ATEX) is designed to facilitate transactions of Assistive Technology (AT) items between residents of Arizona.  This is a user-driven database with entry, edit, delete and search capabilities. The ATEX functions solely as an information-sharing communication channel.

Users listing assistive technology through the ATEX site:

  • Agree to provide accurate and detailed information about the equipment/device specifications and condition to any buyer or recipient in the case of donated items.
  • Confirm that they have the right to sell, exchange or donate the equipment.
  • Commit to properly cleaning and sanitizing the equipment/device (s) prior to posting.  This is particularly true for equipment/device (s) with hygiene related concerns, e.g.: shower transfer seats, commode chairs, toilet safety frames, etc.
  • Acknowledge that listings or postings on the ATEX must be refreshed or renewed every 90 days. If the listing has not been updated, it is subject to removal by ATEX program staff.  
  • Understand that the user’s personal contact information is coded and maintained for program use only.  If you list an item on the ATEX your ad will be assigned an automatically generated ItemID number.  This ItemID number will also appear in the newsletter/printable version of the ATEX.  Users of the ATEX can choose when they set up their ad (s) to have their first name and phone number (s) listed, have persons email them using a secure online form or have ATEX program staff serve as the point of contact. 
  • Accept responsibility for being vigilant about their personal safety and well being when making equipment exchanges. 
  • By using this site you are agreeing to these terms and agree to hold harmless the Arizona Technology Access Program (AzTAP) should you experience a problem with any transaction arising from the ATEX.

Users acquiring assistive technology through the ATEX site:

  • Acknowledge that equipment/items obtained from the ATEX will most likely be sold “as is” with no warranties unless otherwise indicated or offered by the seller.  The buyer or recipient of the item will be responsible for all future repairs and/or maintenance to the item/piece of equipment in the absence of additional seller warranties.
  • Agrees to assume responsibility for being knowledgeable and informed about the assistive technology they are obtaining via the ATEX. 
  • Understands that it is important to involve or use a Rehabilitation Professional such as an Assistive Technology (AT) Specialist, Occupational or Physical Therapist, Speech & Language Therapist or Rehabilitation Engineer to assist with the selection and/or acquisition of any form of assistive technology whenever possible. 
  • Acknowledges that the seller or donator of the equipment/device may not properly clean and sanitize the equipment/device prior to the exchange, and agrees to fully clean and sanitize any piece of equipment/device obtained via the ATEX prior to usage. This is particularly true for equipment/device (s) with hygiene related concerns, e.g.: shower transfer seats, commode chairs, toilet safety frames, etc.
  • Accepts responsibility for being vigilant about their personal safety and well being when making equipment exchanges.
  • By using this site you are agreeing to these terms and agree to hold harmless the AzTAP should you experience a problem with any transaction arising from the ATEX.

The Arizona Technology Access Program:

  • Declines to be involved in financial transactions or issues regarding shipping or transporting of items between buyers, sellers or recipients.
  • Does not profit in any fashion from the sale, donation or exchange equipment/device (s) listed on the ATEX.
  • Does not warranty the condition or control the terms of sale of any piece of equipment/device listed on the ATEX.
  • Provides Assistive Technology (AT) Specialists to assist users of the ATEX with considerations in selecting or attaining Assistive Technology.
  • Reserves the right to edit or refuse listings on the ATEX based on the item description and condition, and remove listings that have not been renewed after ninety (90) days.
  • Prohibits ads for medical equipment/devices such as:  ventilators, nebulizers, CPAP machines and supplies, catheters, oxygen equipment/concentrators, blood glucose meters, hearing aids, eye glasses and prosthetic and/or orthotic devices.  Items such as these should only be dispensed under the supervision and guidance of a licensed practitioner.
  • Codes and maintains user’s personal contact information for program use only. The ATEX will never sell or market any of your personal information for any reason to any outside parties or organizations.  The ATEX makes every effort to protect and secure your personal information. AzTAP will report any misuse or potential misuse of the ATEX site to the appropriate authorities.
  • Makes every effort to ensure that assistive technology listed on the ATEX site are not on a current medical device recall list issued by the U.S. Food & Drug Administration (FDA).  If an item (s) posted on ATEX are found on the FDA recall list the poster will be notified and the ad (s) will be promptly removed. There is a tab on the ATEX home screen for web links to access information on current FDA recalls on medical equipment.  By listing an item for sale, donation or exchange on the ATEX the ad poster is indicating that the equipment/device is not to your knowledge subject to any current FDA recalls.
  • AzTAP does not warrant the condition or terms of sale of any device offered for reutilization or exchange by an existing owner under the ATEX.
  • ATEX shall not be liable for any claims, liabilities, damages, losses, costs, expenses (including but not limited to settlements, judgments, court costs and reasonable attorney's fees) fines and penalties, arising out of any actual or alleged injury, loss, or damage of any nature whatsoever in connection with the sale or use of any device purchased, sold or donated under the ATEX. By accepting these terms, you agree to hold harmless the AzTAP should you experience a problem with any transaction arising from the use of the ATEX.
